Conditions of participation for affiliate and online partners

By applying to an affiliate program or becoming an online partner of SpaDreams, you represent and warrant that you will not violate any of the restrictions set forth below, that you will comply with the cease and desist obligations, and that you will abide by our rules regarding advertising materials. Any violation of your assurance will result in immediate termination and cancellation of commissions generated by violation.

Restrictions

Please note that the following restrictions apply to affiliate partners:

  • No bonus and paidmail systems, no paid clicks or forced clicks
  • No illegal, discriminatory, violence glorifying, political or pornographic sites
  • Postview tracking: Without written consent, no cookie may take place after insertion without user click. A cookie may therefore only be set if the user has seen one of our offered advertising media AND has voluntarily and consciously clicked on it
  • Websites that consist almost exclusively of banners ("banner deserts")
  • Websites, that advertise via adware or spyware
  • The partner is not entitled to commission compensation for bookings that they themself make via their own link via SpaDreams

Injunctions

In addition, the partner undertakes with their application to refrain from the following points:

  • No SEM on Brand (SpaDreams) and the word "Ayurveda" (also not in other spellings or supplemented by other keywords)
  • Use of names of our competitors in ad texts or as keywords
  • Invisible integration of advertising media, setting a cookie without its involvement
  • Mimicking or following the appearance ("look and feel") of SpaDreams
  • Promoting misleading advertising
  • Promoting SpaDreams coupon codes or vouchers without written permission
  • Spamming
  • Cybersquatting or typosquatting. I.e. Neither the name SpaDreams nor any similar sounding or spelled name may be used in the HTML header or domain
  • To use advertising materials and any information contained therein (including but not limited to dynamic XML feeds) in any manner outside of the Affiliate Program
  • The Affiliate is permitted to use the advertising materials and any trademarks contained therein, logos and other elements contained therein only in the context of the Affiliate Program and exclusively within the scope of the respective applicable terms and conditions as set forth herein
  • The Partner may use information on SpaDreams products exclusively in connection with the presentation of the respective SpaDreams travel service and in no case in isolation or otherwise in a manner that creates a relationship between the respective information (e.g., description, images) and a specific product.e.g. description, images) and an offer or service of the Partner or a third party
  • The Partner shall indemnify SpaDreams and its affiliates against all claims of third parties that should be raised in connection with a website of the Partner or its contents. This also includes the costs of a reasonable legal prosecution and legal defense. This provision is valid indefinitely beyond the contract period

Advertising Media

The online partner or affiliate of SpaDreams receives the right to use the advertising media of SpaDreams. However, the advertising materials may not be substantially altered. Although SpaDreams will make every effort to clarify any technical and legal uncertainties, SpaDreams cannot accept liability for any legal claims made by third parties. The latest version of the advertising material should always be used.
